I am writing to request the following information under the Freedom of Information Act 2000.
A copy of the current contract between NHS Scotland, or any of its bodies, and Veolia, or any of its subsidiaries.
Details of any amendments, extensions, or revisions made to the contract since its inception.
Any related performance reports or assessments carried out by NHS Scotland in relation to Veolia's services under this contract, including key performance indicators (KPIs) and their results.
Response
We have now completed the search of our records and can provide you with the following information:
1. A copy of the current contract between NHS Scotland, or any of its bodies, and Veolia, or any of its subsidiaries.
Please find attached Appendix 1 – Veolia Contract_Redacted and Appendix 2 - Terms and Conditions– Services. This is the contract and terms between Veolia and NHS National Services Scotland (NSS) for the Framework NP803/24 Recyclates and General Waste management. The documentation being released includes personal data of third parties, specifically, signatures, names of individuals which have not been released into the public domain regarding this topic or non-senior members of staff. Where this is the case, these names and contact details have been redacted in line with exception Section 38 ((1)(b)) of the Freedom of Information Scotland Act, 2002 (FOISA) – Personal information.
2. Details of any amendments, extensions, or revisions made to the contract since its inception.
Under Section 17 of the Freedom of Information Scotland Act, 2002 (FOISA) an organisation does not have to provide that information if it does not hold it. NSS does not hold this information as this framework went live on 1st April 2024 and no amendments, extensions or revisions have yet been made.
3. Any related performance reports or assessments carried out by NHS Scotland in relation to Veolia's services under this contract, including key performance indicators (KPIs) and their results.
Under Section 17 of FOISA an organisation does not have to provide that information if it does not hold it. Veolia have not been appointed under call off by any of the Health Boards that utilise the framework and as such we would not carry out any performance reports or assessments.
